CRUISE AMERICA 2008 RENTAL CONDITIONS

Customers must understand that all rentals are subject to the terms and conditions of the Rental Contract signed at the Cruise America or Cruise Canada office on departure with the vehicle.  The Rental Contract is the governing document between the renter and Cruise America.  Rental Prices, policies and conditions are subject to change without notice. Below are the principle conditions of the Rental Contract - a complete copy can be provided on request from Just America prior to booking.

Driver requirements: The vehicle can only be operated by qualified drivers over the age of 21, possessing a valid and identifiable driving licence. A major credit card and passport are required as identification prior to rental and will be verified. All drivers must be listed on, and sign, the Rental Contract and will be bound by the terms and conditions of the Rental Contract at vehicle pick-up. There are no charges for additional drivers and no supplement for drivers under 25 years of age.

Max/Min rental periods:
The minimum rental period is 7 nights.  The maximum rental period is 35 nights. For rentals in excess of 35 nights the additional nights will be priced at the Flex rate applicable on night 36.

Extra costs:
Customers will be responsible for any additional mileage, additional propane, campsite fees, road tolls, generator usage and any optional items rented locally i.e. picnic chairs ($7 each per trip – cannot be prebooked).

Child Restraint Seats:
Child restraint seats are not available for rent from Cruise America or Cruise Canada.  Most US States and Canadian Provinces require children under 6 yrs to be secured in a child restraint during travel - see Your Responsibilities - below.  As there are potential issues regarding insurance and the use of private child restraints, Just America does not recommend that children under 6 years should travel in motorhomes or camperhomes.

First night:
Your first night in North America, after an international flight, should be in a motel/hotel.You are not allowed to drive a motorhome on flight arrival day.

Transfer and pick-up times:
Motorhomes cannot be collected or returned on a Sunday or Public Holiday (see dates below).Transfers are not provided (unless you are purchasing the Early Bird Departure Special), however Just America will provide details of how to get to the depot upon request.Customers must call the depot on the morning of the rental to liase with depot regarding their arrival time. Motorhome departure time will be between 13.00 and 16.00 hrs (transfers between 09.00 and noon if you purchase the Early Bird Departure Special).  Please do not plan to drive too far on the first day in case your departure from the depot is delayed.

Familiarisation tour:
A familiarisation tour lasting approximately 25 minutes is required to acquaint you with the operation of the vehicle before departure.The tour is only given during office hours.  Both personal and/or video presentations will be made.

Security deposit:
A security deposit of US$500 (CAD $500) AND the use of a credit card to pay for all local charges and deposits is required at departure. Upon the safe and clean return of the vehicle, all extra charges, if any, are balanced against the security deposit and a credit issued to cover the refund.  For payment of any local charges and deposit by means other than credit card, the security deposit is US$1,000 (CAD $1,500).  For security reasons, since Rental Centers do not carry cash balances, refunds are issued by credit or by cheque (in Dollars) mailed to the renter's home address.

Parking/traffic violations:
Customers are responsible for reporting and payment of all parking/traffic violations at rental termination. Non-reporting of parking/traffic violations may result in an administration charge of up to $250 being charged to the customer’s credit card at the conclusion of the rental.

Optional Use Power Plant – Generator:
The use of a generator is not required for normal vehicle operation and its use is optional and charged at $3 per hour, or unlimited use may be prepurchased at the departure depot at a cost of $6 per rental day. The generator is available with all U.S. based vehicles and C-30's only in Canada. Local sales tax is applied to generator charges.

Mileage charges:
The basic Flex rate does not include any mileage allowance.  If you choose to purchase the Optional Upgrade Pack, you will be allowed 140 miles per day.  Alternatively, you can prepurchase mileage in advance in 500 mile increments - see Flex Prices for cost.  This allows you to estimate and prepurchase the mileage for your itinerary in £'s before your leave the UK.  Unlimited Mileage is also available.  If you don't take the Upgrade Pack, prepurchase 500-mile increments, or take the Unlimited Mileage option, you will be charged for your mileage at the end of the rental at 29 cents per mile (U.S.) and 28 cents per kilometer (Canada). There are no refunds for unused miles. Local sales tax is applied to additional mileage.

Substitutions:
Cruise America will make every effort to provide the vehicle reserved, but Cruise America reserves the right to substitute models of similar or higher quality.Should a model of lower quality be offered and accepted, liability will be limited to a refund of the price difference between the model paid for and the model provided.Should a model of lower grade be requested by the customer, no refund will be due.

Returning the vehicle:
Motorhomes must be returned between 09.00 and 11.00 (no later than 15.00 if you are purchasing the Early Bird Departure Special).  Returns after 11.00 will be subject to a late return charge of $25 per hour. The customer agrees to return the vehicle in the same condition as he/she collected it (excluding normal wear).  Depending on local conditions, a cleaning and/or waste tank evacuation fee may be assessed at vehicle return up to $250.  Renters will also pay for damages or loss of equipment.  There are no refunds for early returns.

Customer Service requirements:
All concerns that a customer may have, whether they are mechanical breakdowns, customer service problems, or holiday impairment, must be reported to the customer services department at Cruise America on the free phone number 1-800-334-4110 in order to be eligible for compensation review.The free phone number is available 24 hours a day and 7 days a week.All complaints must reach Cruise America within six months of returning the vehicle.All complaints should be made in writing.

Restricted areas: Vehicles are restricted from operation in Death Valley and other desert areas during the months of July and August.If the customer decides to travel into these areas during the restricted months, their insurances will be NULL and VOID.In May, June and September travel is permitted, however, during these months, the customer will be held FULLY RESPONSIBLE for any and all mechanical problems or towing.There will be no exceptions to either of these rules.Please note that the rental offices reserve the right to restrict travel during the months of May, June and September as predicting the weather is never constant.During certain periods, these areas are not habitable and could pose a danger to the customer and passengers. Vehicles are not allowed on un-paved roads.  Snow chains are not permitted to be used on any Cruise America/Cruise Canada vehicle. Vehicles are not allowed on “logging” and other non-public roads, and selected dangerous highways such as “The Apache Trail” in Arizona.
Ferry restrictions: Cruise America allow vehicles to be transported on ferries but recommend that customers reserve space for a 27-ft vehicle to avoid problems with upgrading the ferry reservation in the event that Cruise America provide an upgrade vehicle to the customer.

Alaska: Vehicles are allowed to travel to Alaska, Yukon and Northwest Territories, however travel on the Dalton and Dempster Highways and other selected highways is prohibited under all conditions for all vehicles. Violations of these restrictions void damage waivers and the customer may be held liable for all damages and other related expenses.

Mexico: Motorhomes and camperhomes are permitted to travel in northern Baja and Mexican states contiguous to the US border but this must be confirmed in advance. Area restrictions apply during certain periods i.e. summer months.The customer is responsible for Mexican liability insurance purchase, which is sold a southwestern USA rental stations for approximately $20 per day.Travel is permitted into the northern Mexican states of Baja, Tampaulipas, Nuevo Leon, Coahuila, Chihuahua and Sonora only.

New York City: Due to restrictions on vehicle heights, propane gas and parking, motorhomes are not permitted in New York City. Vehicles with propane are not allowed through any underground or underwater tunnels.The customer will be held liable for government-imposed fines relating to use in these restricted areas.

NOTE: Violations of these restrictions is a breach of the Rental Agreement and voids all insurances.The customer may also be held liable for damages or other expenses relating to the use of the vehicle in these restricted areas.Customers will also be held liable for damages to vehicle, tyres, towing charges, and other expenses as a result of a breakdown associated with operating in these areas.

Provisioning Kit:
Vehicle Provisioning Kit  includes a campground guide, flashlight, serving cutlery, cookware set, saucepans, etc., (full list available upon request from Just America). This kit is included in the optional Upgrade Pack

Personal Convenience Kit:
One kit per person. The kit includes a sleeping bag, pillow, pillowcase, queen-size sheet, bath towel, washcloth, plastic laundry bag, bowl, plate, tankard and utensil set.  These kits are included in the optional Upgrade Pack.

Taxes:
Local and state taxes are included in the rental prices, one-way rental fees, prepurchased kits, optional Upgrade Pack and additional mileage packs, Tax on locally purchased or hired items – generator usage, picnic tables/chairs and excess mileage is paid at the rental depot at the prevailing rate.

Public Holidays:
Motorhome depots are closed on Sundays and the following public holidays and no pick-ups or returns may be scheduled for these dates:

Canada 2008 – New Year's Day 01 Jan;  18 Feb (Calgary only);  Good Friday 21 Mar:  Easter Monday 24 Mar;  Victoria Day  19 May;  St. Jean-Baptiste Day 24 Jun (Montreal only);  Canada Day 01 Jul;  B.C. Day 04 Aug (Vancouver only);  Labor Day 01 Sep;  Thanksgiving Day 13 Oct;  Remberence Day - 11 Nov (Vancouver & Calgary only); Christmas Day 25 Dec;  Boxing Day 26 Dec (Toronto only).

One-way rentals:
One-way rentals can be arranged provided they are booked in advance and are subject to one-way rental charges.  Please contact Just America for details.

Motorhome Insurance & Liability - Cruise America Peace of Mind Cover

Auto Liability:
Cruise America maintains liability protection coverages on all its vehicles to a minimum of $10m (US) against claims of bodily injury and property damage brought against the company as a result of the operation or use of its vehicles.This covers Cruise America as a company only. 
Cruise Canada maintains liability protection coverages on all its vehicles to a minimum of $10m (US) against claims of bodily injury and property damage brought against the company as a result of the operation or use of its vehicles.This covers Cruise Canada as a company only.
In both the United States and Canada, the company provides Auto Liability coverage for renters on a secondary basis for bodily injury, property damage and personal injury protection (PIP) as required by the financial responsibility laws of the state or province in which an accident may occur, for claims made against the client and/or authorized drivers.This liability coverage is voided if the rental vehicle is not operated safely in compliance with all applicable laws and regulations and in compliance with all terms and conditions of the Rental Agreement.

Supplemental Liability Insurance (SLI) –USA & Canada
- up to $1m against claims made by third parties for bodily injury, death, and/or property damage caused by the operation of the vehicle - exclusions apply: provides excess coverage between the liability protection limits provided by the underlying protection (the underlying protection is the renter's personal or business protection, when allowable by law and if applicable) up to a total of $1m combined single limit of coverage per occurrence.

Travel Expense Reimbursement -USA & Canada - During a motorhome vacation some aspects of the vehicle system may fail or be impaired.With Travelers Assistance, the objective is to get you back on the road as quickly as possible.If a mechanical breakdown should occur, Cruise America will assist you to secure local maintenance from reputable service providers.All repairs require authorization by phone from Travelers Assistance (1-800-334-4110) who will document your problem on a customer service log.Tools for repair are not provided.Your expenses for authorized repairs, oil change etc., will be paid directly by Cruise America or will be reimbursed upon presentation of receipts. Any vehicle service expense over $75 requires a call to Travelers Assistance.If the cost is under $75 you may have the service completed, but you must keep the receipt for reimbursement.Rental centers are authorized to reimburse receipts up to $75 without a customer service log.Engine battery jump-starts require Travelers Assistance approval in advance.
In the event of a breakdown repair for 12 hours or less, through no fault of the renter, Cruise America's responsibility is limited to a refund of the daily rate or proportion thereof.Radio, air-conditioning, refrigerator, generator, microwave, appliance and cruise control malfunctions are not considered breakdowns and no refunds are available for repair time to these items. Daily rental rate is based on the total time charges paid to Cruise America divided by the total number of rental days of your Rental Contract.

In the event of a mechanical breakdown that is immediately reported to Travelers Assistance and requires the vehicle to be in repair for more than 12 hours certain living/transportation expenses are reimbursable.This does not cover radio, air-conditioning, refrigerator, generator, microwave, appliances, automatic step and cruise control malfunctions since these are not necessary for normal operation of the vehicle.Expense reimbursement is void in the case of collision, accident, or failure to can Travelers Assistance immediately.Expense Reimbursement provides up to $30 per day per person for lodging and transportation expenses – limit $3,000 per tour.

Your responsibilities -
A) Vehicle checkout.
You must receive instructions:
1. On the operation, use, maintenance, safety precautions required on the use of all systems, including, but not limited to, use and installation of liquid propane, appliances, electrical systems and fuelling system.
2. On driving and safe operation of the vehicle.
3. On vehicle servicing responsibilities, including accessing the Cruise America 24-hour, toll-free telephone number (1-800-334-4110) prior to continuance or operation of the vehicle if in doubt about the safe operation of the vehicle.You must comprehend and be familiar with these responsibilities and have all questions answered to your satisfaction.

B) Vehicle Usage, You must operate the vehicle safely in compliance with all applicable laws and regulations and in compliance with
all Terms and Conditions of the Contract including, but not limited to:
1.
Comply with the passenger seating "seat belt" law and child restraint law of any state or province in which the vehicle may be driven.You acknowledge that with any non-compliance of such laws, you shall be contributory and/or comparatively negligent to any injury resulting from such non-compliance.
2.
Keep the vehicle properly serviced and in good running order.Cruise America/Cruise Canada will reimburse you for normal maintenance expenditures up to a maximum of $75.00 during the rental period which will be credited towards rental upon presentation of receipts.  All amounts over $75.00 will require authorization from Cruise America/Cruise Canada by toll-free telephone (1-800-334-4110).
3.
In the event of an accident resulting in injury to vehicle occupants or third parties, or damage, loss, or theft to the vehicle, whether or not due to your fault, you agree to file an Accident/Vehicle Damage report immediately with the police and secure a copy of a police reportand with Cruise America/Cruise Canada by toll-free telephone, and in no case, later than the first to occur of 24 hours after the accident or your return of the vehicle to Cruise America/Cruise Canada.You will obtain at the time of the accident and deliver to Cruise America/Cruise Canada, the name, address, telephone number, driver's license and description, location, owner's name and address of injured parties and damaged property.Failure to comply with this provision will deny Cruise America/ Cruise Canada the opportunity to properly investigate the accident, mitigate the claim and will void Vehicle damage protection coverages as provided under the contract.
4.
Drive on paved roads only; stop, park and overnight in safe areas; and secure the Vehicle in a locked position with keys removed, when away from the vehicle.
5.
Fire alarm, propane alarm, and carbon monoxide detectors are installed for your safety.It is your responsibility to perform the test procedures daily and to repair or replace any device (including battery replacement) prior to continued use of the Vehicle.
6.
Perform safety inspections, including lights, tyres, engine, generator, exhaust systems, mirrors, and Vehicle systems daily and correct any damage or defects prior to continued use of the Vehicle.

C) Vehicle Return
. You must return the Vehicle in the same condition as received on the date due at the location specified and at the time indicated above (see Returning the Vehicle).If you fail to return the Vehicle on the date due, a warrant may be issued for your arrest for unlawfully having the Vehicle and this will be done in accordance with applicable laws.Cruise America/Cruise Canada reserves the right to repossess the Vehicle at any time without demand, at your expense if, in Cruise America/Cruise Canada's sole judgement, the Vehicle appears to have been, or is used, in violation of the Contract or is illegally parked, or is used in violation of law, or is apparently abandoned. Any right to any hearing or to receive any notice of legal process is waived, as a precondition for Cruise America/Cruise Canada recovering the Vehicle.You are responsible for reporting at Vehicle return and payment of ALL parking and traffic violations while the Vehicle was under contract to you.

You are responsible for reporting Vehicle problems and submission of any and all claims for reimbursement including, but not limited to, reimbursement of maintenance expenses as a result of Vehicle breakdown
.All reimbursement claims must be supported by paid receipts and replaced parts where applicable.

D) Personal Property.
It is foreseeable that you, or your passengers will carry personal property in the Vehicle which will exceed the value limits contemplated and provided by Cruise America/Cruise Canada.You must provide a list of the property, proof of value and a certificate of property insurance at Vehicle checkout for any excluded items or property in excess of the limits provided.

Responsibility for Loss or of Damage to the Vehicle -
A)
If any Terms and Conditions of the Contract are breached, including, but not limited to, violation of any part of 'Your Responsibilities' or 'Prohibited Use of the Vehicle' you are responsible for any and all loss of, or damage, to the Vehicle from any cause, regardless of fault and all related expenses. Your responsibility will not exceed the fair market price of the Vehicle at the time of loss or damage, less salvage value, plus, as permitted by law, actual towing, storage and impound fees, an administration charge for expenses associated with processing the loss and damage claim, a charge for loss of use, and other related expenses.
B)
If the Vehicle is used as permitted by the Terms and Conditions of this contract, the following applies: You are responsible for any and all damage to the vehicle from any cause regardless of fault to a maximum of $500.00 per occurrence.

Prohibited Use of the Vehicle -
NOTICE:Any use of the Vehicle as prohibited by the Contract of any failure to fulfil Your Responsibilities will breach the contract; will void any limitation of your responsibility under the contract, and make you fully responsible for Cruise America/Cruise Canada's actual and consequential damages, costs, and attorney's costs and fees resulting from that breach. To the extent permitted by law, Supplemental Liability Insurance (SLI), Personal Injury Protection (PIP) Uninsured/Underinsured, and Liability Coverages will be void.
A)
Operate in violation of Federal or applicable state, provincial, or local laws, rules, regulations, or ordinances.
B)
Carry persons or property for compensation.
C)
Propel or tow any vehicle or other object except as permitted in writing by Cruise America/Cruise Canada.
D)
Engage in any race, or contest.
E
)
Operate in connection with, or during, any period of riot, strike or civil commotion.
F)
Operate if the Vehicle is obtained from Cruise America/Cruise Canada by fraud or misrepresentation.
G)
Allow operation of the Vehicle by anyone except You and/or Authorized Operators.
H)
Use for any illegal purpose or to carry explosives or other hazardous wastes.
I) Drive, or be ferried or transported to any area outside the 48 contiguous United States, or Provinces of Canada or to certain areas
prohibited by Cruise America/Cruise Canada as inhospitable and dangerous, except, with Cruise America/Cruise Canada's prior written approval.The Vehicle may be operated in designated areas of Mexico, Alaska, Yukon and Northwest Territories.
J)
Drive on unpaved back roads, trails, and the like, commonly called "logging" roads or any surface subjecting the Vehicle to damage or road hazard.
K)
Drive during adverse weather conditions, including, but not limited to, areas requiring special tyres or tyre chains or allow placement of tyre chains on the Vehicle.
L)
Drive through any tunnel or area restricting propane tanks.
M)
Allow the Vehicle to be driven by any person under the influence of intoxicants, medications, or drugs, or whose impairment renders the driver unfit to operate the Vehicle or whose medical history may subject the driver to an impaired state (such as blindness and the like) rendering the driver unfit to operate the Vehicle.
N)
Operate or occupy the Vehicle in a reckless or abusive manner which causes damage to the interior or exterior of the Vehicle.
O)
Operate, maintain, or refuel the Vehicle is you have doubts about safe operation and cannot obtain professional assistance or access the Cruise America/Cruise Canada customer service assistance lines.
P)
Further operate or use the Vehicle when signals of apparent problems (monitoring panel gauges, flat tyres, engine overheating, abnormal noise, and the like) indicate damage to the Vehicle or Vehicle systems from continued use.
Q)
Allow the transport of more persons than indicated in the "Capacity" section of the contract.
R)
Allow the transport of any person in the camper portion of camperhomes (truck campers), or allow the detachment of the camper from the truck chassis.
S)
Allow placement objects or persons, for any purpose, on the roof, including in a parking position for viewing.
T)
Operate if improperly loaded, or if load is improperly secured, and if Vehicle doorsteps are not properly stowed.
U)
Allow placement of signs, lettering, painting, or other legend or loudspeakers or other sound apparatus on the Vehicle.
V)
Tamper, modify, disassemble or change Vehicle in any way, including speedometer tampering.
W)
Allow the Vehicle to be used for ambulance service, whether for hire or not, or for carrying person(s) whose medical well-being depends on operation of Vehicle systems.
X)
Further operate the Vehicle after it has been involved in an accident or is damaged, regardless of fault, before the Vehicle has been properly repaired or otherwise certified to be roadworthy and in compliance with all applicable safety standards.
